TERMS AND CONDITIONS
1. YOUR CONTRACT
The following terms and conditions will be incorporated into every contract between you and SAIL COSTA CALIDA. By making a deposit payment or full payment (by using our online booking portal, bank transfer, PayPal or credit/debit card) you will be accepting the terms and conditions for all members of your party, and you are therefore advised to read them carefully. This contract will be construed in accordance with English Law and it is agreed by us that each will submit to the jurisdiction of the UK courts.
2. BOOKING
To ensure availability of the sailing charter or course for the dates you require, please check availability using our online booking system or by contacting us directly. We also take bookings through WhatsApp, Facebook or Instagram.
Our prices are based on the following seasons:
LOW SEASON - November - March (Excluding Easter)
MID SEASON - April, May, October, Easter
HIGH SEASON - June - September
Bookings are made based on a price per person, per cabin (for overnight trips) or for the whole yacht. Unless otherwise stated we may have mixed groups on our charters and courses. If you do not wish to share the boat with another group we strongly recommend booking the whole yacht to ensure exclusive use for your group. You have the option to book the WHOLE YACHT during the booking process.
3. PAYMENT
Payments made through the sailcostacalida.com website are made securely using the PayPal Secure Online Payment System. You can pay using either a debit/credit card or a PayPal account. If you wish to pay using a Bank Transfer please contact us directly.
If your trip is more than 21 days in the future you must pay a 25% deposit to secure your booking. With the final balance payable 21 days before your trip. If you fail to pay the final payment on time SAIL COSTA CALIDA reserves the right to cancel your trip or course, with no refund of deposit.
If your trip is less than 21 days in the future you must pay the full amount to secure your booking.
4. CANCELLATIONS AND REFUNDS
If you choose to cancel your trip with more than 48 hours notice a 25% deposit will be forfeited.
If you choose to cancel your trip with less than 48 hours notice the full payment will be forfeited.
If for any reason SAIL COSTA CALIDA are unable to run the trip on the date you have booked, due to bad weather or other external factors, we will contact you with as much notice as possible. We will do our very best to reschedule your trip for another day that suits you. In the unlikely event that this is not possible we will refund you in full. Any refund will be limited to monies already paid.
5. AMENDMENT
If you choose to reschedule your trip with more than 48 hours notice this can be done free of charge.
If you choose to reschedule your trip with less than 48 hours notice there will be a 50€ administration fee as we are unlikely to be able to resell the seats for your original trip.
All trips rescheduled by you are subject to additional charges if the trip is moved from Low Season to Medium or High Season as detailed below:
LOW SEASON - November - March (Excluding Easter)
MID SEASON - April, May, October, Easter
HIGH SEASON - June - September
6. ADDITIONAL SERVICES
Any additional services provided by a third party, e.g. Jet Ski hire, are subject to the terms and conditions of the third party provider. This includes, but is not limited to cancellations, amendments and refunds.
7. GIFT VOUCHERS
Gift vouchers are valid for 48 months from the date of purchase and are not transferable. They can be used in full or part payment against any sailing trip or course offered.
8. INSURANCE
SAIL COSTA CALIDA will insure the vessel against all usual marine risks. It is important and a condition of our accepting your booking that all persons travelling are covered by appropriate travel insurance.
9. SMOKING POLICY
SAIL COSTA CALIDA operates a strict no smoking and no vaping policy on board the yacht.
10. TRIP TERMINATION
You must accept responsibility for the proper conduct of yourself and any members of your party. We reserve the right at our absolute discretion, to terminate without further notice, the trip/course of any client who refuses to comply with the instructions or orders of the skipper or authorised SAIL COSTA CALIDA staff member. Any behaviour by an individual in our opinion, likely to cause distress, danger or annoyance to fellow crew, other customers, staff or any third party or property will be required to leave the trip/course.
11. INTOXICATION
Complimentary alcohol is served as part of some of our trips. We reserve the right at our absolute discretion, to refuse to serve any individual who, in our opinion, is intoxicated to the extent that they are likely to cause distress, danger or annoyance to fellow crew, other customers, staff or any third party or property. We reserve the right at our absolute discretion, to terminate their participation immediately. Upon such termination our responsibility for your trip/course ceases and SAIL COSTA CALIDA shall not be liable for any extra costs incurred by you.
Under no circumstances is any alcohol permitted on our courses or whilst the yacht is underway during the hours of darkness or if the yacht is more than 5 nautical miles from land.
12. YACHT SPECIFICATION
SAIL COSTA CALIDA may alter the specification of the yacht if it is deemed necessary to either ensure that you gain the maximum benefit from your charter, or to ensure the safety of yourself and the other water users.
13. PHOTOGRAPHY
Frequently SAIL COSTA CALIDA crew photograph our sailing activities, for use in SAIL COSTA CALIDA's publicity material only. This includes social media. Should you object to photography taking place whilst you are on board please let us know in advance.
14. FORCE MAJEURE
Neither party shall be liable if prevented from fulfilling any of its obligations by an incident of force majeure including weather conditions, an act of god, strikes, lock out, act of government or any other occurrence beyond their control.
Should the weather conditions not be suitable on the day of the trip or course you have booked we will notify you either in advance or on the day. Where possible we will move your trip or course to another mutually convenient date. If this is not possible we will refund you in full.
15. PHYSICAL ABILITY
Sailing can be physically demanding at times. Please ensure you have an appropriate level of physical fitness prior to booking a course. If you have any questions then please get in touch.
16. AGE RESTRICTION
Any persons under the age of 18 must be accompanied by a parent or guardian.
17. COMPLAINTS PROCEDURE
SAIL COSTA CALIDA has an established complaints procedure that is to be used should the need arise. Please contact us for more details.
18. DATA PROTECTION
Personal details given to SAIL COSTA CALIDA for the booking of your trip/course will not be shared with any party outside of SAIL COSTA CALIDA.
